TRANSSEXUALS AND TRANSGENDER PEOPLE AND THE BRAZILIAN SOCIAL SECURITY SYSTEM

Abstract

The article examines the exclusion of transgender individuals from the Social Security System, highlighting the effects of conservatism. It analyzes the legal and social issues regarding their rights to Social Security, given the barriers imposed by the current model. A qualitative, quantitative, and explanatory methodology is used, based on literature, legal documents, statistical data, and judicial decisions. The results reveal the gap between Constitutional Theory and practice, with the exclusion of this minority due to binary criteria and weak legislation, emphasizing the urgency for reforms that ensure civil parity through calculations validating gender identity. The study highlights the importance of aligning social security policies with constitutional principles of equality and human dignity, opposing the influence of conservatism in the legal process.
